Job Description

Associate Attorney litigating debt-collection matters for a Nebraska creditor's rights law firm. Managing caseloads, court proceedings, pleadings, motions, and legal-risk analysis remotely.

Responsibilities:

  • Attend court and court hearings when required
  • Sign pleadings and settle cases
  • Handle all aspects of litigation and manage an independent caseload
  • Litigate debt collection matters
  • Review correspondence and files for appropriateness
  • Review answers
  • Prepare discovery and dispositive motions
  • Prepare for and conduct trials
  • Represent clients in pre-suit and post-judgment matters
  • Analyze and advise on legal and regulatory risks
  • Develop strategies adhering to state and federal rules, regulations, and compliance standards
  • Keep abreast of changes in state and local rules
  • Perform other attorney tasks as assigned

Requirements:

  • Admission to the Nebraska Bar and licensure to practice law in Nebraska
  • Background in civil litigation and experience attending court proceedings
  • Knowledge of federal, state, and local laws
  • Ability to analyze case law and provide recommendations
  • Ability to draft legal pleadings, motions, discovery, stipulations, and other legal documents
  • Ability to write, review, and edit reports, opinions, correspondence, articles, and other documents
  • Familiarity with state and federal consumer laws and changes in state or local rules
  • Ability to independently manage a caseload
  • Excellent oral and written communication skills
  • Ability to prioritize and organize high volumes of information
  • Ability to work in a deadline-driven environment
  • Ability to interact effectively with people at all organizational levels
  • Ability to work-related travel
  • Additional Iowa licensing preferred
  • Knowledge of Bankruptcy Law, Foreclosure Law, or FDCPA/FCRA/TCPA is a plus
  • Experience in collection law and/or significant courtroom experience is a plus
  • Must be able to occasionally lift up to 25 pounds
  • Must be able to access and navigate each department at the organization's facilities
