Job Description
Associate Attorney litigating debt-collection matters for a Nebraska creditor's rights law firm. Managing caseloads, court proceedings, pleadings, motions, and legal-risk analysis remotely.
Responsibilities:
- Attend court and court hearings when required
- Sign pleadings and settle cases
- Handle all aspects of litigation and manage an independent caseload
- Litigate debt collection matters
- Review correspondence and files for appropriateness
- Review answers
- Prepare discovery and dispositive motions
- Prepare for and conduct trials
- Represent clients in pre-suit and post-judgment matters
- Analyze and advise on legal and regulatory risks
- Develop strategies adhering to state and federal rules, regulations, and compliance standards
- Keep abreast of changes in state and local rules
- Perform other attorney tasks as assigned
Requirements:
- Admission to the Nebraska Bar and licensure to practice law in Nebraska
- Background in civil litigation and experience attending court proceedings
- Knowledge of federal, state, and local laws
- Ability to analyze case law and provide recommendations
- Ability to draft legal pleadings, motions, discovery, stipulations, and other legal documents
- Ability to write, review, and edit reports, opinions, correspondence, articles, and other documents
- Familiarity with state and federal consumer laws and changes in state or local rules
- Ability to independently manage a caseload
- Excellent oral and written communication skills
- Ability to prioritize and organize high volumes of information
- Ability to work in a deadline-driven environment
- Ability to interact effectively with people at all organizational levels
- Ability to work-related travel
- Additional Iowa licensing preferred
- Knowledge of Bankruptcy Law, Foreclosure Law, or FDCPA/FCRA/TCPA is a plus
- Experience in collection law and/or significant courtroom experience is a plus
- Must be able to occasionally lift up to 25 pounds
- Must be able to access and navigate each department at the organization's facilities
