Job Description
Counsel managing the College’s disciplinary process and representing them in various legal proceedings. Involves maintaining a caseload, preparing for hearings, and providing strategic guidance.
Responsibilities:
- Independently manage a caseload of disciplinary matters, registrar appeals, and fitness-to-practice proceedings
- Manage timelines to ensure all deadlines are met
- Prepare for hearings
- Review evidence, prepare witnesses, and conduct or oversee legal research
- Conduct settlement discussions with licensees and/or their counsel
- Draft, review, and prepare legal documents and legal opinions
- Attend case conferences, motions, Tribunal hearings, and judicial reviews
- Assist Lead Counsel and provide guidance to Associate Counsel on complex disciplinary matters
- Collaborate with Lead Counsel on prioritization, strategy, and case management for disciplinary matters
- Collaborate with investigators by advising on investigation strategy and reviewing investigation reports
- Prepare legal opinions for consideration by the Complaints Committee to recommend next steps for handling a complaint
- Identify and advise Lead Counsel on the need for policy or procedure development or changes related to disciplinary, registrar appeal, and fitness-to-practice matters based on analysis of legal issues encountered in disciplinary matters
- Liaise with external counsel on complaints retained by external counsel to manage
Requirements:
- Law degree (LL.B. or J.D.) and membership/licence to practice law in a Canadian province
- 5–7 years of litigation or prosecutorial experience in private practice or a regulatory environment
- Knowledge of prosecutorial standards and practices, professional regulation, and administrative law
- Knowledge of the Federal Courts Act and Federal Court Rules
- Knowledge of dispute resolution methods and forensic investigation techniques
- Proficiency with office and administrative software
